Preston Hughes IIIPreston Hughes III was arrested in the early morning hours on September 27, 1988, for the brutal stabbing death of Shandra Charles, age 15, and Marcell Taylor, age 3. He was tried, convicted and sentenced to die by lethal injection.  He has been on Texas Death Row since May 1989 for a crime he did not commit.

At around 2:15 a.m. the Houston police knocked on Preston's door, came in, looked around for a few minutes, then asked Preston if he would come down to police headquarters.  In spite of the fact that Sergeant Gafford would not answer his question, "What is this all about?", Preston agreed to go because he knew he had done nothing wrong. By 6:40 a.m., after being yelled at, lied to, slapped in the face and punched in the chest, Preston, fearing for his very life, signed the last page of Officer Gafford's typed false confession to the murders of these two young children.

The following Time Recap of events is based on the actual information obtained from the Houston Police Department case file. Preston and his mother provided me with some of the documents in the case file that they had obtained but I also ordered a copy of the case file including crime scene photos. What I received was interesting. I did not receive a copy of the Property Division Evidence & Property Invoice showing that Officer Hale had seized seven items from Preston's apartment two and a half hours before Preston allegedly signed a consent for search and seizure form which was also not included along with the consent to take samples of blood, urine or hair. Officer Hale reported that he took two rolls of 35mm film (36 exposures each) and 21 Polaroids making a total of 93 photos. I received 74 35mm photos and 21 Polaroids making a total of 95. Of those photos, 10 were apparently aerial shots of Preston's apartment complex.  Officer Hale made no mention in any of his reports that he went to an airport and boarded an aircraft to make aerial photos. There were also 18 photos that were obviously from another crime scene(s). So how many missing photos does that make? See Crime Scene Photos WARNING! There was no evidence collected by the Houston Police Department that tied Preston to these murders not even the knife that was seized from Preston's apartment which was tested, not in the lab, but in the courtroom before the judge, the prosecuting and defense lawyers just before the "forensic expert" was to testify. The results - positive for animal blood not human blood and the judge allowed the knife to be introduced at trial as the murder weapon. (See "Great Moments in Forensic Science" article) Preston was definitely tried in a Kangaroo Court with the chief characters being his defense lawyer, the Assistant District Attorney, the "forensic expert", several sergeants at the HPD, and even the judge.

Officers V. L. Cook and D. J. Becker were flagged down by Drew Curtis Hartley regarding his missing wife. He thought she had been abducted and drug into a field in the 2400 block of S. Kirkwood. Officers proceeded to that location and were flagged down by Jaime Hunter, a employee of Fuddruckers. Hunter said that on his way home from work he had seen a female lying on the dirt path and had returned to work to call the police. (See Officers Report Pg 2.022)
09/26/88 11:?? p.m. Path behind Fuddrucker's
2400 S Kirkwood
Officers Cook and Becker proceeded down the dirt path and discovered a 15 year old black female and a 3 year old black male. Hartley's wife was found later unharmed. The female had a stab wound to the left side of her throat and another one to the left side of her chest. She was breathing deeply and unconscious. The male had 2 stab wounds to the left side of his chest and a cut behind his left ear. He was not breathing. (See Officers Report Pg 2.022)
09/26/88 11:43 p.m. 2400 S Kirkwood Sgt. Hamilton arrived at scene. Even though Officers Cook and Becker stated the girl was unconscious, according to Sgt. Hamilton, he asked the girl what happened. She said "He tried to rape me." He asked who? She said "Preston" . He asked for his last name but couldn't understand what she was saying. He asked for her name. Her response sounded like "Lashandra" or "Lasanda". She identified the boy as "Marshell" or "Marchell" and that he was her cousin. Hamilton also noted that she was bleeding from the left side of her neck, she was having a hard time breathing, and her speech reached the point it was impossible to understand. Sgt Hamilton notice that the girl's shorts were unbuttoned, unzipped and partially off her hips. (See Officers Report Pg 2.025)

Sgts. Gafford and Bloyd receive call from Lt. Neely to go to crime scene. (See Officers Report Pg 2.003)
09/26/88 11:55 p.m. HFD Ambulance Ambulance arrived at the scene. According to Officer J. L. Waltmon, who had been requested by Lt. Neely to go to hospital, the boy was DOA and the girl was in route to West Houston Hospital but diverted to Ben Taub Hospital. He arrived at the hospital about the same time as the ambulance. (See Officers Report Pg 2.003)
09/27/88 12:05 a.m. Houston Police Department Officer F. L. Hale received call from Homicide Lt. to go to crime scene. (See Officers Report Pg 2.017)
09/27/88 *12:30 a.m. 2310 Crescent Park Sgts. Gafford, Bloyd and Hamilton arrive at apartments.
09/27/88 12:35 a.m. 2400 S Kirkwood Officer Hale arrives at scene. Meets with Gafford & Bloyd and collects the following items: 1. White leather handbag shoulder strap later determined to be used as girl's belt 2. Empty Busch Beer Can -Printed by Hale - no prints found. Hale took 2 rolls of 35mm file and 21 Polaroid photos of scene and morgue (See Officers Report Pg 2.018)
09/27/88 12:?? a.m. 2310 Crescent Park Gafford spoke with two security officers. One of the officers, Noe Guajardo, provided Gafford with an apartment complex residents list. Gafford reviewed this list with Complex Manager, Joe Casler. The only Preston on the list was Preston Hughes. Gafford also showed a Polaroid photo of the boy to Property Manager, Leisa Barham, for identification but she did not know the boy. (See Officers Report Pg 2.009) Note: At trial, Joseph Casler, Project Complex Manager of the apartments testified that at around 1:00 a.m. he gave Sgt. Gafford a set of master keys to the apartments and pointed out three of the five or six master keys that would open Preston's apartment door. This was not included in this officer's report. (See Sgt. Ferguson's report Pg 2.028 regarding Preston "voluntarily" giving him the key at HPD.)
09/27/88 12:54 a.m. Ben Taub Hospital Officer Waltmon learned that the girl was pronounced dead by Dr. Mark Bailey. He noted she was wearing the following:
1. A blue and white stripped long sleeve shirt and white bra.
2. Had one fan shaped silver earring in left ear.
3. Gold colored ring on little finger of left hand
4. Silver ring on ring finger of left hand.
(See Officers Report Pg 2.024) Note: None of these items were listed in the plastic hospital bag that Officer Hale collected later.
09/27/88 ??:?? a.m. West Houston Hospital 12111 Richmond Gafford requested Hale to go pickup personal belonging of girl. The attending nurse gave him a plastic hospital bag marked "Personal Belongings of Jane Doe" and contained the following:
1. Pair white shoes
2. Pair of white shorts
3. Torn paper with name Dog and phone number 884-1217 from left pocket of shorts
4. Gold neck chain with safety pin
5. Five $1 bills and one $5 bill

09/27/88   Harris County Morgue Hale fingerprinted both victims. Two autopsy request forms were completed. (See Officers Report Pg 2.019)
09/27/88 2:15 a.m. 2310 Crescent Park Apt 138A According to Sgt. Gafford, he, Sgts. Bloyd and Hamilton arrive at Preston's apartment. Preston states that Sgt. Bloyd was not present. Another uniformed officer was with Gafford and Hamilton.

While Gafford questioned Preston, the other officers look around his apartment. Preston asked Gafford several times what this was all about but he would not say. Finally Gafford asked Preston it he would be willing to go to the police station. Preston agreed to go and got dressed in black jeans, black short-sleeved shirt, a maroon belt and white and blue tennis shoes. Gafford made a note in his report about seeing a pair of silver rim eyeglasses on the couch but at that time he gave little thought about them. (Interesting notation) (See Officer Report Pgs 2.009 and 2.010)

09/27/88 2:35 a.m. 2310 Crescent Park Apt 138A Preston was put in the back of squad car and transported by Officer M. A. Vincento to HPD. Gafford and two other Sgts. stayed behind. (See Officer Report Pg 2.010)
09/27/88 2:58 a.m. HPD Property Division Hale turned in the following items to the HPD Property Division:
1. White shoulder strap (Shandra's found at the scene)

09/27/88 *3:05 a.m. Houston Police Department Squad car arrived at HPD. A short time later Cynthia Brown identified the two victims as Shawn Brown and Marcell Brown. (See Officer Report Pg 2.010) Note: The two victims where later identified as Shandra "Shawn" Charles and Marcell Taylor.
09/27/88 4:30 a.m. Houston Police Department According to Sgt. Gafford he arrested Preston after he learned that Preston knew Shawn, that she had named "Preston" as being her attacker, and that Preston lived near the crime scene. (See Officer Report Pgs 2.010-2.011)
09/27/88 5:30 a.m. Houston Police Department Voluntary Consent for Search and Seizure form witnessed by Sgt Ted C. Bloyd
09/27/88 5:35 a.m. Houston Police Department Voluntary Consent for Search and Seizure form witnessed by Sgt T. M. Ross
Note: Preston DID NOT sign this form. It appears that his signature was cut and pasted to the form and a copy made of the form which was presented as an alleged original. Also note this form was supposedly witnessed approximately 2-1/2 hours AFTER Officer Hale had already turned in 15 items from the crime scene including 7 items seized from Preston's apartment to HPD Evidence & Property room. See attached search and seizure form and compare to time (2:58 a.m.) reflected on Evidence & Property Invoice) At trial Sgt Ross testified that the first time she saw Preston was when Sgt. Gafford asked her to witness Preston's false confession at 7:15 a.m.
09/27/88 5.40 a.m. Houston Police Department After being told the typical lies and exposed to temper tantrums that interrogating officers such as Sgt Gafford use, plus being slapped in the face and punched in the chest, Preston asked the Sgt. if he were under arrest. The Sgt. nodded Yes. Preston was never read his Miranda rights. Preston asked the Sgt. if he could make a phone call. The Sgt. said No, you will get your chance to make a call but you are going to give me a statement and sign it before you do. This was not in the Sergeant's report. (See Officer Report Pg 2.011)(Pgs 2.014-2.015)

When Preston started reading the statement he told the Sgt that wasn't what he said. The Sgt. told him to sign it and he would get his chance to change it later. Fearing for his life, Preston reluctantly signed the statement. (See Officer Report Pg 2.015)

09/27/88 8:30 a.m. CSU Office According to Hale, he was notified by Sgts Ferguson and Yanchak that they had a search and seizure form and asked him to meet them at Preston's apartment. According to these Sgts. Lt, Zoch had told them that Sgt. Gafford had obtained a statement from Preston in which he had stated that the clothing he was wearing and the knife he used were at his apartment. Sgt Ferguson said that Preston had voluntarily given the key to his apartment to him. It was later learned that Sgt. Gafford obtained a key to Preston's apartment from the manager before he knocked on Preston's door and a spare key on the kitchen counter was also taken. (See Officer Report Pg 2.019)(Pg 2.028)Note: According to this report Hale was notified to collect evidence 5-1/2 hours AFTER he had already turned in 7 items from Preston's apartment at 2:58 a.m.
09/27/88 9:15 a.m. 2310 Crescent Park #138A Ferguson and Yanchak arrive at apartment. Their report shows that Hale recovered the following items from the apartment:

09/27/88 10:?? a.m. 2400 S Kirkwood According to Hale, after he finished at the apartment, he returned to the original scene and found silver ring with "Avon" inscribed. (See Officer Report Pg 2.021) Note: Hale listed a silver ring in the evidence he turned in at 2:58 a.m. At the hospital, Officer Waltmon observed the girl wearing a silver ring. Do we now have three silver rings?
09/27/88 10:?? a.m. 9235 Westheimer #184 After the evidence was collected Sgts. Ferguson and Yanchak paid Evelyn Brown a visit. She had know Shawn for about 1-1/2 years and Preston about 1 year. She stated that Shawn had told her that she had been to Preston's apartment where he made sexual advances toward her. Evelyn stated she had told Shawn several times to stay away from him. (See Officer Report Pg 2.029) Shawn had been to Preston's apartment numerous times to use his electricity while he was at work. She was like a sister to him.
09/27/88 11:?? a.m. Houston Police Department Sgts Ferguson and Yanchak returned to homicide office. One of the Sgts was reviewing Preston's statement and noticed that he had not described killing the little boy so he decided to reinterview Preston. (See Officer Report Pg 2.029)
09/27/88 11:45 a.m. 5th Floor Men's Jail Sgt. Ferguson picked up Preston and took him back to homicide office (See Officer Report Pg 2.029)
09/27/88 12:20 p.m. HPD Homicide Office Interview Room According to Ferguson and Yanchak's report Preston was willing to give a second statement and he was mirandarized. Preston has another story.
Sgt. Yanchek entered the interview room and identified himself as Sgt. Garrison. He told Preston the following:
"I don't believe your story. We found marijuana on the girl, and we found a bag in your apartment. I believe you were with the two kids before you stabbed them. What did you do, trade some marijuana for a piece of young tight pussy? Come on you can tell me the truth. I know how you people are trading drugs for sex. You're going to give another statement to my partner, Sgt. Ferguson when he come in this room. If you don't I'm going to kill you because I have kids and I have nightmares of someone like you coming after them. Or hell, I'll just beat your ass all over this room and put you in Ben Taub. I'm sure they'll love to have and treat another patient. And who do you think the judge will believe, a piece of shit like you or me, a police officer? Now do I make myself clear?"
Preston did as he was told because he was afraid of losing his life. He was given his Miranda rights only after the statement was typed and before Sgts. S.L. Clappart and J. R. Swaim witnessed his involuntary signing of the two page statement at 1:15 p.m. (See Officer Report Pg 2.030)
09/27/88 1:40 p.m. 5th Floor Men's Jail Sgt. Yanchak checked Preston back into jail. (See Officer Report Pg 2.030)
09/27/88 2:15 p.m. Houston Police Department Sgt. Yanchak attempted to return a call from Attorney Ron Mock received at 1:30 p.m. but he was not in his office. (See Officer Report Pg 2.030)
09/27/88 3:25 p.m. Houston Police Department Sgt. Ferguson received a call from Ron Mock who wanted to know if charges were going to be filed against Preston and that he might be retained as his attorney. (See Officer Report Pg 2.030)
09/27/88 3:50 p.m. Houston Police Department Ron Mock called again and said he had been retained by Preston's family and if they needed to interview Preston again to contact him first. (See Officer Report Pg 2.030) (See attached article regarding this lawyer's incompetence.)
09/27/88 4:16 p.m. Houston Police Department Sgt Gafford asked Officer K. A. Hilleman to tag for the property room the following:
1 Pair of Diadora brand white with blue trim tennis shoes
1 Maroon colored belt with metal buckle. (See Officer Report Pg 2.031) Note: Preston was wearing these items when he was taken to HPD.
04/22/89   Houston Police Department Sgt Gafford and ADA Chuck Noll met. Noll requested Sgt. have crime lab examine all evidence for blood. (See Officer Report Pg 2.034)
04/24/89   Houston Police Department Noll requested Gafford to take the vaginal swab from Shandra to Jim Bolding at the crime lab to examine. (See Officer Report Pg 2.034)
04/24/89   Houston Police Department Officer J. Bolding received and examined one vaginal sample. Semen was detected on the vaginal swab but according to lab report it was very weak positive for semen and not enough to type. (See Officer Report Pg 2.038)
04/27/89   Houston Police Department Officer J. Bolding retrieved the following from the police property room:
1. 1 Strap

3. 1 Pair of Shorts
4. 1 Pair of Shoes
5. Ten dollars cash
6. Piece of paper
7. 1 neck chain with safety pin

Blood was indicated on one of the blue shirts and the pair of blue jeans, but according to lab report there was not enough to determine if human blood and not enough to type. All the remaining evidence was retained without examination. Also note there are no eyeglasses listed. (See Officer Report Pgs 2.037-2.038)
05/05/89   Houston Police Department Sgt. B. E. Frank received the following items from the morgue and placed them in drying room:

02/28/01   Houston Police Department The homicide division received a copy of a U. S. District Court Order to preserve all evidence in this case. (See Officer Report Pg 2.040)
01/19/06   Houston Police Department HPD received a request by the Harris County District Attorney's (HCDA) Office to take possession of evidence previously held by the HPD that was turned over to their personnel in preparation of trial. (See Officer Report Pg 2.040)
05/04/07   Houston Police Department Sgt. J. C. Wood was assigned to carry out the retagging of the evidence held by the HCDA's office. Sgt. Wood met with HCDA Investigator Joe Vara to take custody of evidence in this case. The evidence was held in one cardboard box and contained the following:
1. 1 empty Busch beer can
2. 1 white strap
3. 1 pair of tennis shoes
4. 1 maroon cloth belt

Bed sheet from Preston's Apartment Removed but not logged in. Sheet was stained with fresh semen. Is it possible that this was used to contaminate vaginal swab?
Taxi Cab Dispatch Records Manager/Supervisor of Yellow Cab testified that dispatch records are destroyed after six months so there was no way to locate the cab driver who picked up Preston at the Circle K. This information is not correct.
Douglas Swanson Rosalynd Calhoun saw a man fitting Swanson's description entering the crime scene area with Shandra and Marcell. He drank Busch beer and smoked Benson and Hedges cigarettes. Preston's former roommate saw bloody footprints leading from the crime scene in the direction of the apartment complex where Swanson lived. Swanson abruptly left the Houston area soon after these murders. He did not notify his employer at Days Inn where he was a security guard and left word with his cousin that if anyone asked about his whereabouts he was in California. It was later learned Swanson was living in Tyler Texas with his grandmother. The police should have photos of these footprints but if they do they were never made available.

In 1991 Douglas Swanson was arrested and convicted of aggravated sexual assault with a deadly weapon. He is now serving a life sentence at Ferguson Prison in Midway, Texas.
Tracy Heggar Tracy Heggar testified at Preston's trial that he had raped her in 1985 when she was thirteen years old. She testified further that Preston had threatened her with a gun in an attempt to prevent her from testifying against him about the alleged rape.

Preston states another female gave Tracy his phone number In October 1984 and she called him. They continued to talk on the telephone until the middle of December 1984 when he finally went to meet her in person. She led him to believe she was 17 and would be 18 in a few months. He had no reason to believe she was lying about her age because she worked at McDonald's and he knew she had to be at least 16 to work there. Throughout the many times he visited Tracy at her home, they never had sexual intercourse. They had oral sex.

The day that she accused him of raping her, they had oral sex. While she was in the bathroom cleaning up, he used the phone in her mother's room to call his girlfriend, Camille. While talking he turned around a Tracy was standing outside the room listening. He tried to pretend he was talking the his cousin Shawn. When he got off the phone, he told Tracy that he was going to join the Army which made her mad.

He found out from his mother that Tracy was accusing him of rape. He called the police and spoke to Sgt. Yarborough in the Sex Crime Division and told him one of his girlfriends was accusing him of rape and how he could prove that he didn't rape her. The Sergeant couldn't find that any complaint had been filed. A month or so later Preston was arrested and charged with aggravated sexual assault of a child. That is when he learned that Tracy was 13.

Preston called Tracy's mother and found out that Tracy had told her that she didn't know Preston and that he had broken into their apartment and raped her. The mother asked Preston to describe the layout of her apartment which he did to her satisfaction. She told him that she had given Tracy permission to lie about her age so she could get a job. Tracy's mother attempted to drop the charges twice but the police wouldn't let her. They told her that Preston's semen matched the semen they found on her bed sheets. Preston states he had never even sat on her mother's bed. He believes the semen was from a guy named Joey who told him that he had had sex with Tracy that morning. (Is it possible that James Bolding was involved in the semen testing?) Tracy had a reputation of being sexually active even with her uncle whom she also accused of raping her.

She claimed that Preston shot at her at a bus stop at the corner of Westheimer and Dunvale. She said he stopped his car, jumped out, ran over, shot at her, got back in his car and left. Westheimer was under construction. It would have been impossible for anyone to have accomplished this feat in broad daylight without being seen and without causing a traffic jam in an already congested area. Plus, he had been in a car accident that caused the driver's door to jam. He also had two witnesses who could vouch for his whereabouts at the time he supposedly shot at Tracy. He gave this information to his court appointed lawyer who shared this information with the Assistant District Attorney. Tracy's story about the shooting was changed to he was driving down the street chasing Tracy with his car and when she ran into to her home, he fired shots into the apartment but there were no bullets to backup this story and she couldn't even remember what color the car was.

Preston accepted a plea bargain rather than trial by jury fearing that a jury would convict him based on their feelings instead of the facts. He received 10 years probation for the aggravated sexual assault and aggravated assault with a deadly weapon.


APPEAL FOR HELP

Preston is in urgent need of support to enable him to finance the services of a lawyer to have an effective successive Writ prepared and filed in the Texas Court of Criminal Appeals as soon as possible. The purpose of the Writ is to persuade the Justices of the Court to take a closer look into the matter of the fabricated Consent for Search and Seizure and issue an order to have the "Original Exhibit" of the Voluntary Consent for Search and Seizure form, in evidence, examined by a Forensic Document Examiner to determine its authenticity.

Every lawyer appointed to allegedly represent Preston has purposely ignored this matter because once it is determined the original exhibit is NOT AUTHENTIC, it will shine a light on all the wrongdoings of the HPD Police, the prosecutor and court appointed lawyers and eventually lead to proving Preston's innocence and setting him free.
