Florida Supreme Court Justice Gerald Kogan (Ret.) said, “Anybody who understands the justice system knows innocent people are convicted every day.”
There are at least 200,000 innocent people in prison and 90% pled guilty. How does this happen?
Eyewitness identification WRONG 50% of the time.
Detective or fraudulent science – experts reporting incriminating results from test not conducted or concealing results that could exonerate the accused. Faulty DNA matching. High error rate in crime labs and medical examiner’s offices.
Police Misconduct – Ignoring evidence that does not fit. Using manipulative tactics to coerce a confession. Looking for incarcerated snitches willing to frame suspects. Evidence tampering. Witness intimidation.
Prosecutor Misconduct – Have a win at all cost mentality. Use media to convict suspects before trial. Withholding evidence. Present perjured testimony. Misrepresent evidence during closing arguments. Manipulate and/or misrepresent evidence before the trial to coerce a guilty plea.
Bad Defense Lawyer – Does not meet with client, does not understand facts, does not hire experts, does not investigate, does not review discovery, does not subpoena or call defense witnesses, does not effectively cross-examine state’s witnesses, does not object to objectionable argument, does not argue motions or closing statements effectively. In other words, DOES NOTHING! Bad lawyering occurs equally among public defenders and private lawyers.
